As SMARTES TEKNOLOJİ YAZILIM DANIŞMANLIK SAN. TIC. LTD. ŞTİ. as Data Controller, we show maximum sensitivity to the security of personal data, especially the protection of fundamental rights and freedoms, especially the privacy of private life in the processing of your personal data. With this Clarification Text, in accordance with the provisions of the Law No. 6698 on the Protection of Personal Data (“KVKK”), we inform you about the collection and transfer of your personal data, the purposes of processing, legal reasons and your rights. This Clarification Text has been created for real persons who send us messages containing questions/requests and complaints by filling out the contact form on our website.
In addition, we will also share with you our Procedure for Storage and Destruction of Personal Data upon your request.

Data Controller

In accordance with the LPPD, your personal data may be processed by our company, which was established and continues its activities as a Limited Company in accordance with the laws of the Republic of Turkey, as the data controller, within the scope described in this Clarification Text.

Personal Data and Processing of Personal Data

Pursuant to KVKK, any information that makes your identity specific or identifiable constitutes your personal data. Data relating to race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, appearance and dress, membership to associations, foundations or trade unions, health, sexual life, criminal convictions and security measures, and biometric and genetic data constitute personal data of special nature.
Processing of your personal data refers to all kinds of operations performed on the data such as obtaining, recording, storing, preserving, modifying, reorganising, disclosing, transferring, taking over, making available, classifying or preventing the use of such data in accordance with the KVKK.
Your personal data processed in the capacity of data controller includes your identity information (Name-Surname,) and contact information (telephone number, e-mail address), the name and title of the company you work for, your country, city and the message you want to send.

Purpose of Processing Personal Data

Your personal data mentioned in this Clarification Text may be processed and transferred in order to manage the requests and complaints regarding the products for which sales / maintenance or support services are provided, to respond to any questions you want to ask regarding the goods and products, and to continue promotional and marketing activities.
Your personal data are processed in accordance with the principles of compliance with the law and honesty rules, being accurate and up-to-date when necessary, being processed for specific, clear and legitimate purposes, being connected, limited and measured for the purpose for which they are processed, and being kept for the period required by the relevant legislation or for the purpose for which they are processed.

Method and Legal Reason for Collecting Personal Data:

Your personal data, in order to provide the services we offer within the legal framework determined and in this context, in order for our Company to fulfil its obligations arising from the Contracts and legal legislation in a complete and accurate manner, our general directorate carries out our activities by being reached physically or electronically through channels such as our website and all other verbal, written or electronic media by automatic or non-automatic methods and through other channels through which our Company communicates with you or may communicate in the future.
Your personal data collected for this legal reason can be processed and transferred for the purposes specified in this Clarification Text within the framework of the personal data processing conditions and purposes specified in Articles 4, 5 and 6 of the KVKK. The legal reasons for processing are as follows: Provided that we establish a contractual relationship with you or it is directly related to our performance obligation arising from this contract, it is necessary to process your personal data (for example, in accordance with the signed Contract, we provide support if you request about the use of the machine), Legitimate interest of the data controller (for example, keeping complaint records directed to us in order to improve our activities as a result of requests and complaints), Your explicit consent where necessary (for example, processing your data in cloud computing systems and transferring it abroad)

Transfer of Personal Data:

TIC. LTD. ŞTİ. to the foreign business partner, shareholders and the relevant department causing the problem within the framework of the personal data processing conditions and purposes specified in Article 8 of the Law.

Rights of the Personal Data Owner
Your personal data:
i. To learn whether or not they are being processed,
ii. Requesting information if your personal data has been processed,
iii. To learn for what purpose your personal data are processed and whether they are used in accordance with these purposes,
iv. To know the third parties to whom your personal data are transferred domestically or abroad,
v. To request correction of your personal data in case of incomplete or incorrect processing,
vi. To request the deletion or destruction of your personal data,
vii. Request notification of your correction, deletion and destruction requests to third parties to whom your personal data are transferred,
viii. To object to the occurrence of a result to your detriment by analysing your processed data exclusively through automated systems,
ix. You have the right to demand the compensation of the damage in case you suffer damage due to unlawful processing of your personal data.
